General terms and conditions

Version of 15 August 2025, supplemented on 18 October 2026. This is a courtesy translation. The German version is the legally binding one.

Contract

The contractor is Räumen24 GmbH, Saatlenstrasse 18, 8051 Zürich. It operates under the brand “Räumen & Werten”, referred to below as “Räumen & Werten”.

The viewing and the quote carry no obligation for the contracting party.

A contract is in place when a written order or an offer is confirmed and the parties agree on how to proceed. The parties accept the following terms. Amendments require the written consent of Räumen & Werten. Räumen & Werten may amend the terms at any time without separately notifying existing contracting parties. Amendments that affect the contracting party will be communicated in writing.

Obligations of Räumen & Werten

Räumen & Werten undertakes to provide the services agreed with the client to the greatest possible extent and to the client’s satisfaction. Räumen & Werten is liable for damage, interruptions or disruptions caused by employees of Räumen & Werten. Räumen & Werten is liable only for the services agreed with the client. Räumen & Werten is not responsible for damage, interruptions or work stoppages caused by third parties or force majeure. Räumen & Werten may withdraw from the contract at any time if the work cannot be completed satisfactorily because of malicious interference by third parties or force majeure.

Obligations of the contracting parties

The contracting party undertakes to provide all documents and information required for the agreed service in good time and no later than 48 hours before the service is performed. If the contracting party does not comply with this request and this leads to delays, defects or even non-performance of the services provided by Räumen & Werten, the contracting party is liable for the failure to comply with the contract. In this case Räumen & Werten may charge proportionate reimbursement of the expenses incurred up to that point. If the performance of the service by Räumen & Werten contravenes applicable law in any way, or if the contracting party suffers damage through the services, the contracting party alone is liable.

Credit for goods and purchase

Räumen & Werten may buy usable household goods. The purchase is a sale contract alongside the clearance order. It is recorded in the quote or on a purchase receipt. The purchase price is a single price for the household goods as a whole, not an appraisal of individual items. Ownership passes to Räumen & Werten on handover.

The purchase price is set off against the price of the clearance. Clearance and purchase appear as separate lines in the statement. If the purchase price exceeds the price of the clearance, the surplus is paid out, in cash against a receipt or by bank transfer. Above an amount set by Räumen & Werten, payment is by bank transfer only. Proceeds from a later resale do not change the agreed purchase price.

The contracting party confirms that they are entitled to dispose of the items. For estates, guardianships and powers of attorney, they prove their authority on request, for example with a certificate of inheritance, an executor’s certificate, a deed of appointment or a power of attorney. Where several persons are entitled, Räumen & Werten pays the person shown to be entitled to dispose. Dividing the money among several entitled persons is not the responsibility of Räumen & Werten.

While the period to disclaim an estate is running and not all heirs have accepted the inheritance, Räumen & Werten does not buy and does not set off. Clearing and storing remain possible once authority is proven. The purchase is made up once all heirs have accepted or the period has expired.

Cash, securities, identity documents, personal papers, photographs, keys and wills are not bought. Räumen & Werten returns them or hands them to the competent authority. Weapons and ammunition are neither bought nor transported. Items whose value cannot be reliably assessed are not credited and, on request, are left out of the clearance.

Warranty

The contracting party must check the services provided by Räumen & Werten carefully without delay after performance, and in any case within 12 hours. Any defects must be notified in writing without delay within this period. Any defects or errors in the performance of the service are remedied by Räumen & Werten by agreed improvement within the agreed period or by a reduction in the price of the service. The warranty obligations of Räumen & Werten lapse if the contracting party changes, rearranges or discontinues the services of Räumen & Werten, including the goods supplied.

Service processing

The services of Räumen & Werten are to be paid net in accordance with the agreed payment terms. Additional costs that become necessary in the course of performing the service and that are communicated to and approved by the contracting party are possible within the framework of the contract terms.

Cancellation

An order is, as a rule, cancelled within 8 days by registered letter or e-mail.

If the order is cancelled after this period, the contracting party of Räumen & Werten pays up to half of the order volume.

Orders placed less than 8 days in advance cannot be cancelled, unless the service can no longer be provided without adversely affecting Räumen & Werten.

For an open-ended contract for the regular provision of several services, this contract must be terminated with 3 months’ notice to the end of a month. Termination must in any case be in writing.

Termination by the contracting party or by Räumen & Werten does not release either side from the services already provided or from payment during the agreed contract term.

Jurisdiction

The place of jurisdiction for notices of Räumen & Werten is Zürich. Räumen & Werten may, however, also assert its claims before the courts of the contracting party’s general place of jurisdiction. Any exclusive place of jurisdiction remains unaffected. Swiss law applies.
